Austin State University • www.sfasu.edu MINUTES TO THE PLANINNG AND ZONING BOARD August 14, 2017— 5:00 p.m. City Council Chambers Members Present: Matt Turner, Jay Anderson, Stephanie Malott, , R.J. Bohac, Don Mills Members Absent: None Others Present: Amy Mehaffey, Jeff Opperman, Steve Roan, Herman Gibson, Roy Bolden, Kerry Carter, Jan Gibson, Lindsey Gibson. 1. Call to Order: Commissioner Turner opened the meeting and called it to order at 5:00 p.m. 2. Approval of Minutes: July 10, 2017 Regular Session: Commissioner Malott made a motion to approve the minutes. Commissioner Anderson seconded the motion and the motion to approve passed unanimously. 3. Public Hearing: Consider the request for approval of a final plat for Arthur Weaver Subdivision, No. 2, located on Arthur Weaver, Fox, Brown, and Orton Streets. This request has been submitted by Roan Surveying Company. Interim City Planner, Amy Mehaffey explained the request and presented the plat. Steve Roan spoke and stated that they only wanted to make lots compliant with minimum size. The new design will fit the character. Commissioner Bohac questioned the 20' by 10' compliance. Roan stated that he can take lots 1, 3, 4, and 6 and make all compliant. Commissioner Anderson proposed construction cause setbacks. The carport will extend to curbline, overall need to move lot lines. He suggested they change and resubmit. Commissioner Bohac made a motion that they change and resubmit with changes with 100 foot regulation added from other lots. Chairman Turner made motion to resubmit with changes. Commissioner Mills seconded the motion. With the rest of Commissioners voting aye to resubmitting with changes. 4. Public Hearing: Consider the request for approval of a plat for Rust Second Subdivision, located on Zeno Street. This request has been submitted by Opperman Surveying. Interim City Planner, Amy Mehaffey stated that this property is zoned R-1, Single Family Residential and by State law if the lot meets the size requirement, the board must approve the request. P&Z Minutes Page 1 Chairman Turner asked if there was anyone to speak for or against the request. Matthew Gallager stated that he lives on Zeno Street. And for the people who have lived there a long time, he believes that this will take away character. Jeff Opperman stated that the lots meet the minimum requirements. Lots are '/2 acre each. Applicant is splitting one lot into two. Gallager stated that this lot has been subdivided five times and that he would like less development in this area. A neighbor spoke and said that he lives across the street and that he would like to speak against the request. Mehaffey stated that by law this request must be approved because the lots meet the size requirements. Turner called for a motion. Commissioner Anderson made a motion to approve the request. Bohac seconded the motion and the request was unanimously approved. 5. Public Hearing: Consider the request for a zone change from R-1, Single Family Residential, to B-2, General Business, for Lot 48-A, City Block 64, located at 3623 E. Main Street. This request has been submitted by the American Legion Post 86.ZON2017-03. Interim City Planner, Mehaffey, explained to board that this Veteran Chapter would like to expand their meeting space and in order to do so, it must be rezoned. Herman Gibson stated that he is the Commander of the chapter. This property is 1.52 acres. They would like to construct a storage/wall of honor/ parking and remove current house. We have been in Nacogdoches 98 years without building. We constructed a concession trailer to raise funds for lot. Roy Boden stated that he supports Legion. He asked if there was a time frame for building. Mehaffey stated no there is not. Turner asked if there was any further discussion for or against. There was none. He called for a motion. Commissioner Bohac made a motion to approve the request. Commissioner Mills seconded the motion. This request was approved unanimously. This request has been submitted by the Rayford Green Estate. ZON2017-004. SUMMARY/BACKGROUND: The property owners are working with a realtor to presumably sell this property. They have not indicated their plans for future use. However, zoning changes are not dependent upon proposed land use. Therefore, the request should be based upon adjacent zoning and not potential property usage.
