1. Call to Order: Commissioner Turner opened the meeting and called it to order at 5:00
p.m.
2. Approval of Minutes: November 13, 2017 Regular Session:
Commissioner Anderson made a motion to approve the minutes. Commissioner Bohac
seconded the motion and the motion to approve passed unanimously.
3. Public Hearing: Consider the request for approval of a preliminary plat for the
Starr Avenue Addition, Lot 23-C, City Block 54, located at 2800 E. Starr Avenue.
This request has been submitted by Tommy Findesien.
Interim City Planner, Amy Mehaffey explained the request and stated this is a plat of a R-
1, Single Family Subdivision broken into five small lots. The applicant plans to build a
single family home on each lot. Each lot permits one driveway.
Commissioner Bohac questioned the driveways. .
Mehaffey stated there will be one given per lot onto Starr and three to four on Skyline.
David Rankin states he has lived on Skyline Drive for twenty years and is concerned
about the replatting. The topography is uneven, which causes this to be the steepest
street in the city of Nacogdoches. He is concerned about water runoff.
Randall Cox stated he owns 2.4 acres adjacent to this lot in question. He shared a map to
show the size of the lot to be divided. He is concerned with flooding/erosion. Does not
want this property to degrade home values.
Peter Fernandez stated he owns 3 acres to the left of this lot. He states that the lot does
not have the width for new lots. He is concerned about the safety and suggest widening
the street and water retention.
Dorothy Sheedy stated that she is opposed to the development. Not compatible with
existing homes.

CONDUCT A PUBLIC HEARING AND CONSIDER A REQUEST FOR APPROVAL OF A
PRELIMINARY PLAT FOR THE DECKARD SUBDIVISION (LOT 10-1/ 2- B, PART OF LOT 10-13-2 AND
PART OF LOT 10-B-6, BLOCK 62), GENERALLY LOCATED ON LAMAR AND SUTTON STREETS,
NACOGDOCHES TEXAS.
Background
The request is for a preliminary plat approval for the Deckard Subdivision. The subdivision is located in the south
eastern part of the city as indicated on the attached Location Map.
Plat Design
This is a five (5) lot subdivision in a built out residential neighborhood. The site is currently a stretch of land with
houses. The purpose of this subdivision plat is to subdivide the stretch of parcel to create lots for every individual
house on site. There are four houses on site, hence one lot will be vacant (Lot 1 -Please reference attached plat)
Proposed Development
The site is already developed with four buildings. One of the lots created is vacant and can be used for any
development allowed in the R-3 zoning district.
Zoning Issues
All the lots are zoned R-3, Two Family Residential. This zoning classification requires a minimum lot size of 50 feet
by 100 feet, for a total of 5000 square feet. All the lots conform to the subdivision regulations except for Lot 5, which
does not meet the lot depth requirement of 100ft. However the lot size is 5629.28sq ft. which exceeds the required
minimum lot size of 5000sq ft. The lot width is also 66.55ft which is greater than the required lot width of 50ft.
This is an older neighborhood which was developed many decades before the existence of the zoning or subdivision
ordinances. The plat has done well to put each building on a separate lot. All lots in the proposed subdivision are
currently owned by one individual. Approval of the subdivision plat, while unusual due to the circumstances stated
above, will allow each of the houses to have its own lots and allow easy accessibility, identification for emergency
services, and future planning initiatives. This plat is a good initiative towards bringing nonconforming uses and lots
to meet current development and zoning regulations.

Drainage, Utility, and Access Issues
Staff has reviewed the plat and determined there are no issues with the plat. All properties proposed will have
adequate access.
Flood Damage Prevention:
No portion of this property lies within the 100 year or 500 year flood hazard areas.
Notices:
Staff sent out thirty (30) notices to property owners within the 200 foot notification area. There were zero (0)
responses received in favor of the request, and zero (0) responses received in opposition of the request.
Staff Recommendation
Staff recommends approval of the Preliminary Plat for the Deckard Subdivision based on the following;
1. The plat does not pose any adverse impact on surrounding properties and is adequately served by all
required utilities.
2. As described above, this is a unique and built up neighborhood and strictly applying the rules of the
zoning and subdivision ordinances will not be in the best interest of the neighborhood. However the plat
meets almost all the zoning and subdivision requirements as stipulated in the City of Nacogdoches
Ordinance.
Action by Planning and Zoning Commission
This subdivision plat must be reviewed by the Planning and Zoning Commission because more than 4 lots are
being created.
1. Motion to approve/disapprove a preliminary plat for the Deckard Subdivision (Lot 10-1/ 2- B, part of
Lot 10-B-2 and part of Lot 10-B-6, Block 62), generally located on Lamar and Sutton Streets,
Nacogdoches Texas based on staff's recommendation and findings.
2. Any other action deemed necessary.

Background
The request is for a preliminary plat approval for the Jeff Reed Subdivision. The subdivision is located in the north
eastern part of the city as indicated in the attached Location Map.
Plat Design
This is a three (3) lot subdivision in a built out residential neighborhood. The site is currently made up of four lots.
The purpose of this subdivision plat is to reconfigure the lot lines in order to create access for the landlocked lot
located at the rear of the properties, or to improve the accessibility and circulation in the subdivision. There are
currently three homes on site and they will remain as is.
All the lots conform to the subdivision regulations stipulated for the R-1 zoning district
Proposed Development
The site is already developed with single family homes. The owner has not indicated any intentions of replacing or
changing the land use.
ZoningIssues
This property is zoned R-1, Single -Family Residential. This zoning classification requires a minimum lot size of 75
feet by 110 feet, for a total of 8250 square feet. As shown in the attached plat, the lots exceeds these requirements and
therefore in conformance with the zoning regulations.
This plat is a good initiative towards bringing nonconforming uses and lots to meet current development and zoning
regulations.
