Call to Order: Commissioner Turner opened the meeting and called it to order at 5:00 p.m. 2. Approval of Minutes: March 12, 2018 Regular Session: Commissioner Anderson made a motion to approve the minutes. Commissioner Bohac seconded the motion and the motion passed unanimously (5-0) 3. Staff Presentation: I. Discussion on tree preservation in the City of Nacogdoches II.Discussion on SWOT (Strengths, Weaknesses, Opportunities, and Threats) Analysis for future planning projects. Planning Director, Mr. Leo Mantey stated that in his coming to Nacogdoches and driving around and observing surroundings, it does not feel as though any trees are needed, but as the city continues to grow, there is a need to preserve trees. Homes with nicer landscaping have higher property values. If there no trees, the air would be filthy. Trees are very necessary. Our current ordinance currently encourages commercial landscaping for commercial use. City staff does recommend preserving trees to builders. Nacogdoches is not only unique but also historical as well. Commissioner Bohac stated that when Mr. Mantey says non commercial, is he referring to residential? Planning Director, Mr. Mantey stated yes. Commissioner Bohac stated that property owners would have to be actively involved in this discussion to ensure sustainability. Commissioner Anderson stated that it is cost prohibited to replace. Other members also agreed on that. Chairman Turner stated that there could be trees along the creek in Festival Plaza, which is a streamside management zone. Commissioner Bohac stated that contractors should be made to submit the tree preservation on their site plans. P&Z Minutes Page 1 Director of Planning, Mr. Mantey, stated that the city of Tyler requires developers to provide their tree preservation plan along with their site plan submittal. Commissioner Bohac stated that tree preservation in residential zonings would have to have some stipulations to ensure that an orderly method is being adhered to. Commissioner Anderson stated maybe they should put some materials together to educate the public on the economic importance of tree preservation. The Chairman then opened the meeting up for public comments. Charles Phillips stated that almost everywhere he has lived, other than Nacogdoches, had a tree preservation ordinance. The current commercial ordinance for trees and landscaping is not adequate for tree preservation. He stated that Nacogdoches has bad parking lots, which he believes is an area with wasted asphalt. He claimed there is a huge difference between parking lots when you visit areas like the Woodlands. He stated there is a link between land value and utilization. II. Director of Planning, Mr. Mantey, asked that everyone give strength of Nacogdoches. Chairman Turner stated the inherent natural beauty and public space. Commissioner Bohac stated the community interaction. There are people who love this city. Commissioner Mills stated the overall participation by all people in the community. An example is the involvement of people in Comprehensive planning. Commissioner Mallot stated the University sets us apart. He said it is obvious when you get close to campus with all the azaleas and even the downtown area with pocket parks. Commissioner Anderson stated the resources, both natural and manmade. The Chairman opened the meeting up for public comments. Charles Phillips stated the history of Nacogdoches makes the City unique Nick Domovich stated the location is unique. It is not far from the metroplex area but yet exist on its own with its unique culture. Commissioner Turner stated the public space and green spaces is also a strong character. Commissioner Bohac stated the quality of life and tradition. Commissioner Mallot stated this is the oldest town in Texas. He said he feels the doors could be blown open and used to our benefit. Planning Director, Mr. Mantey, went on to explain the next exercise and asked for weaknesses of Nacogdoches. P&Z Minutes Page 2 Commissioner Turner stated the drainage, flooding areas, and aging infrastructure. Commissioner Bohac stated tradition, and non promotion of new growth. Commissioner Mills stated better working relationship with citizens. Commissioner Mallot stated that she hears a lot that there is nothing to do here. Nothing to do for fun. She stated that she plans trips for her family outside the city to have fun, but there has to be a way to utilize what we have. Commissioner Anderson stated that we have a long way to go to recover from the 1960's and 1970's with what has been done to North Street and University Drive. Chairman Turner opened the meeting for public comments. Charles Phillips stated that Nacogdoches doesn't understand economic value and that a lot could be done to promote the city. Chairman Turner stated that he had to add that the school system here is in disarray. Agenda Item #4: Staff Announcements Planning Assistant, Ms. Turner, asked the board members if they liked the way they received their packet for this meeting, which was through digital email. They were all in favor of that. She then stated that the next meeting is May 14, 2018. She stated that if there were items on the next agenda, we would still have more discussion, and if they thought of something helpful or an idea before, they should contact our office. The applicant informed staff she plans to build a beauty salon/parlor on the site. The entire property is approximately 1.9 acres. The rezone is for a portion of the lot (Approximately 2400 sq ft) which meets the requirements of the B-2 zoning district. The site is zoned for only residential uses, hence the request to rezone to B-2, to legally allow the construction of a beauty salon/parlor. If approved, the entire site development will adhere to all regulations and requirements of the B-2 General Business Zoning district. The applicant informed staff, they are aware of surrounding residential uses and will do their best to ensure that their operations does not have any adverse effects on surrounding uses and neighbors. Existing Land Use The entire lot is currently vacant and abounds commercial and residential zones. The surrounding land uses are as follows North Vacant and abounds businesses on South Street South Residence, office/storage East Construction and storage facility West Vacant A reconnaissance survey of the area shows a mixed use neighborhood with different housing types and businesses. Femdale Street also intersects South Street on the east, which is predominately a commercial arterial. Staff believes beauty salons are less intense commercial uses as compared to the surrounding commercial developments, and will serve the surrounding residential neighborhoods well. Moreover the development will adhere to all regulations and requirements in the zoning and subdivision ordinance of the City of Nacogdoches to ensure safety, compatibility and harmonization of land uses. Based on the above factors and existing uses along Ferndale Street, staff believes the proposed use will be compatible with surrounding uses and will likely not have any adverse impact on the surrounding uses. Zonin The zoning designation for 210 Ferndale is R-3, Two Family zoning. Surrounding zoning include; North B-2 General Business/ R-3, Two -Family Residential South B-2 General Business/ R-3, Two -Family Residential East B-2 General Business West R-3 Two -Family Residential Staff believes that the proposed rezoning request is compatible with the neighborhood due to the presence of B-2 zones surrounding greater portions of the proposed site. The presence of B-2 zones along the streets has led to the presence of commercial uses of higher intensity in the neighborhood; as such the proposed beauty salon is of less intensity and will not be the City of Nacogdoches 202 E. Staff therefore believes the proposed rezoning to B-2 will be compatible with the neighborhood and surrounding zones and will likely not have any adverse effects on the neighborhood and surrounding zoning districts. Future Land Use Per the 2003 Nacogdoches Comprehensive Plan, the Future Land Use for the site has been designated for Single Family Residential_ Surrounding Future Land Use designation as follows; North Single Family Residential South Single Family Residential/Commercial East Commercial/Single Family Residential West Single Family Residential Due to the changes in development and growth since 2003, the area has primarily been zoned for Commercial and Two Family housing development. One of the goals of the Comprehensive plan is :Reducing the "strip commercial" potential along the City's major roadway corridors compared to the 1994 plan and the current zoning map, instead encouraging clusters and nodes of commercial development within convenient distance of residential population concentrations and at major highway interchanges (this will also avoid "dilution " of the City's existing commercial districts, such as the North Street and University Drive corridors as well as the Central Business District downtown). Development along Ferndale already has mixed uses and meets the ideals of the aforementioned goal of the Comprehensive Plan. The Future Land Use Map for the area shows a mix of Commercial and Single Family Residential. Staff therefore believes that, granting the rezoning will likely not have any adverse impact on the Future Land Use designation of the area. Flood Damage Prevention: Per the FEMA Floodplain Map, no portion of this property lies within the 100 year or 500 year flood hazard areas. However any drainage issue will be addressed during the platting and development stage. Notices: Staff sent out 21 notices to property owners within the 200 foot notification area. There were zero (0) responses received in favor of the request, and zero (0) responses received in opposition of the request. However staff received about four phone calls from citizens responding in favor of the request. Staff Recommendation Staff has reviewed the rezoning request and believes the request if granted will allow for a land use that will be a good fit for the neighborhood. The proposed use requested will also be developed in accordance with the Zoning and Subdivision regulations stipulated in Chapter 118 and 90 respectively of the Nacogdoches Code of Ordinances and will therefore meet the ideals of the city ordinances and ensure compatibility of land uses. Staff therefore recommends approval of the rezoning request from R-3, Two -Family Residential to B-2, General Business, for a portion of Lot 24, Block 56, generally located at 210 Ferndale Street based on the following: 1. The applicant informed staff; they are aware of surrounding residential zones and believe the intended use will be a good fit for the surrounding zones. Existing Land Use The entire lot is currently vacant and abounds commercial and residential zones. The surrounding land uses are as follows North Vacant South Office/storage, Residences East Residences (Single family, manufactured home. West Storage facility, Hotel The area due to its close proximity to the Loop has some mixed use development on surrounding properties. There is a storage facility and hotel behind the said property on the west facing North West Stallings Drive. A reconnaissance survey of the area shows that a greater portion of the land uses along Gasaway Road is for residential purposes which are primarily single family homes and manufactured homes. Also the high intense commercial uses face the Loop thereby making Gasaway a safe residential street. Staff believes this down zoning from commercial to a residential zone will not have any adverse impact on surrounding uses. Development along Gasaway Street is primarily residential; hence additional residential development in the neighborhood will be compatible with existing uses and will be an improvement in the neighborhood. Staff believes that the requirements outlined in the City's subdivision ordinance will ensure that the residential development will be protected from the neighboring commercial development on the south and west of the property in question. Zoning The zoning designation for the said property along Gasaway Road is B-2 General Business. Gasaway Street also links into a residential subdivision on the south; it is therefore appropriate for developments along the street be zoned for residential purposes to match the character and uses existing in the neighborhood. Staff therefore believes the rezoning, if granted, will likely not have any adverse impact on surrounding zoning districts. One of the goals of the Comprehensive Plan is to encourage Growth Inward- Long-term growth in appropriate areas to achieve an efficient, diverse and balanced pattern of land uses both within the City and urbanizing portions of its extraterritorial jurisdiction. Some of the targeted objectives include; • Encourage infill development where appropriate (utilities, compatibility, etc.). • Coordinate the location, type and density of land use activity with utilities and transportation planning to ensure desired development outcomes. • Plan for mixing and/or separation of land use types based on desired, location, density and pattern of development. • Promote growth where adequate infrastructure exists. This rezoning request will end up being an infill development that will ensure a balance of uses within an area. In this regard though the area has not been designated for a specific use, this rezoning if granted will help achieve some of the long term goals and objectives of the Comprehensive Plan outlined above. This rezoning is therefore consistent with the 2003 City Comprehensive Plan.
