Call to Order: Chairman, Matt Turner opened the meeting and called it to order at 5:05 p.m. 2. Approval of Minutes: June 11, 2018 Regular Session: Commissioner Malott made a motion to approve the minutes. Commissioner Bohac seconded the motion and the motion passed unanimously (4-0) 3. Public Hearing: Consider the request and take action for a zone change from Agriculture, to R-3, Two -Family Residential, for Lot 29, City Block 54, property ID 24725, located in the 700 block of Tower Road. Z18-03. Planning Director, Mr. Leo Mantey explained this request. He stated that the site in question is vacant. The applicant wishes to rezone to R-2 in order to build a duplex on the site. Staff believes this would be a great project for this area and would be consistent with the neighborhood uses and zoning. All of this area is zoned for residences; the property is also out of the flood zones. Mr. Mantey stated staff approves the rezoning because it is consistent with the Future Land Use Map. Chairman Turner asked if the plan was to construct one duplex. Mr. Mantey stated yes. Chairman asked if there were any questions for Mr. Mantey. There were none. He asked if there was any one to speak in favor or against the request. Andrew Middlebrook stated that he owns this piece of property and that he wishes to build a duplex there. He stated that he would most definitely be nice. He stated that he appreciated the board members consideration on this matter. Chairman Turner asked if there was anyone else to speak in favor or opposition of. There was no one else to speak. He called for a motion. Commissioner Bohac made a motion to approve the request as written. Commissioner Mills seconded the motion and the request was approved unanimously. Naco oc es the oldest town in Texas Planning and Zoning Commission Date: August 13, 2018 Agenda Item: 3 PRESENTER: Leo Mantey, Planning Director ITEM/SUBJECT: Public Hearing: Consider ordinance amending the boundaries of a zoning district within the City of Nacogdoches from R-1, Single Family Residential, to R-2, Single Family Residential, for Lot 89, City Block 54, Property ID 13112, located on Appleby Sand Road. Submitted by Wier and Associates. ZON2018-04. Background The request is for a zone change from R-1, to R-2, Single Family Residential, on Lot 89, City Block 54, property ID 13112, generally located 0.85 miles north Loop 224 along Appleby Sand Road at the edge of the city limits. The applicant informed staff the land is being rezoned to develop a new residential subdivision for the construction of single family homes. The 15 -acre property is currently zoned R-1 which allows a minimum lot area of 8250SF. The development proposes to change the zoning to R-2 to provide some variety of lot sizes in the area. Conforming to the R-2 zoning, the minimum lot width is 60' wide and will have a minimum surface area of 6,000SF. The concept plan depicts 60 residential lots with the typical lot size of 6,500 SF (60'x109), concrete curb and gutter streets, and utility connections to both public water and sanitary sewer. Storm water mitigation will be controlled by a retention pond located on the south side of the property. The pond will be maintained by the HOA and will have walking trails and benches to add a park -like atmosphere. The development will also preserve some trees to help preserve the character of the neighborhood. If approved, the entire site development will adhere to all regulations and requirements of the R-2, Single Family Residential Zoning district. The applicant informed staff; they are aware of surrounding residential zones and believe the intended use will be a good fit for the surrounding zones. Existing Land Use The entire lot is currently vacant and abounds commercial and residential zones. The surrounding land uses are as follows; North Vacant South Residences East Outside City Limits/Residences West Residences The area is primarily made up of residential uses with some pockets of vacant lots. The stretch of land along Appleby Sand Road in that area is made up of single family subdivisions; hence additional residential development in the neighborhood will be compatible with existing uses and will be an improvement in the neighborhood. Staff therefore believes that granting the rezoning request will not have any adverse effect on surrounding land uses. Zoning The zoning designation for the said property along Appleby Sand Road is R-1 Single Family Residential. Surrounding zoning include; Naco oc es the oldest town in Texas North R-1, Single -Family Residential South R-1, Single -Family Residential East Outside City Limits West R-1, Single -Family Residential Planning and Zoning Commission Date: August 13, 2018 Agenda Item: 3 The major difference between the R-1 and R-2 zoning district is the lot sizes. R-1 allows for minimum lot sizes of 8250 SF whereas R-2 allows 6000SF. The reduction in lot sizes does not implying building smaller houses in this district. Usually it allows for decent housing sizes, but, with smaller front and back yards. Staff believes this rezoning will allow for varying housing choices which is much needed in the City. It is therefore appropriate for the subject property to be zoned for residential purposes to match the character and uses existing in the neighborhood. Staff therefore believes the rezoning, if granted, will likely not have any adverse impact on surrounding zoning districts. Future Land Use Per the 2003 Nacogdoches Comprehensive Plan, the Future Land Use for the site has been designated as Single Family Residential. Surrounding Future Land Use designation as follows; North Single Family Residential South Single Family Residential East Outside City Limits West Single Family Residential The rezoning if approved will conform to the Future Land Use designation of the area. One of the key components of the 2003 City Comprehensive Plan is to encourage the building of desirable neighborhoods. The goal is to encourage "A variety of safe, high-quality residential areas that meet the needs of Nacogdoches residents': The objectives of this goal are ; Provide suitable areas for a variety of residential types and densities Preserve the character of existing neighborhoods, and ensure that future neighborhoods live up to this standard This rezoning is approved will help achieve the above goal and objectives of the Comprehensive plan by creating a subdivision that will give citizens different housing choices while preserving the character of the neighborhood. This rezoning is therefore consistent with the 2003 City Comprehensive Plan. Flood Damage Prevention: Per the FEMA Floodplain Map, no portion of this property lies within the 100 year or 500 year flood hazard areas. However any drainage issue will be addressed during the platting and development stages. Notices: Staff sent out 18 notices to property owners within the 200 foot notification area. There were zero (0) responses received in favor of the request, and zero (0) responses received in opposition of the request. Naco oc es the oldest town in Texas Planning and Zoning Commission Date: August 13, 2018 Agenda Item: 3 Staff Recommendation Staff has reviewed the rezoning request and believes the request if granted will allow for a land use that will be a good fit for the neighborhood. The proposed R-2 zoning is allowed for single family homes on smaller lots sizes as compared to the existing zoning. The R-2 zoning brings different housing choices into the neighborhood. This development can also be a catalyst to propel future development in the adjacent Extra Territorial Jurisdiction (ETJ). The proposed use requested will also be developed in accordance with the Zoning and Subdivision regulations stipulated in Chapter 118 and 90 respectively of the Nacogdoches Code of Ordinances and will therefore meet the ideals of the city ordinances and ensure compatibility of land uses. Staff therefore recommends approval of the rezoning request from R-1, Single Family Residential, to R-2, Single Family Residential, for Lot 89, City Block 54, Property ID 13112, located on Appleby Sand Road based on the following: 1. The rezoning will likely not have any adverse impact on surrounding zoning districts; the proposed land use will also not have any impact on surrounding land uses and will be developed in accordance to city regulations. 2. Per the 2003 City of Nacogdoches Comprehensive Plan, the proposed rezoning if granted will be consistent with the City's Comprehensive Plan. Action by Planning and Zoning Commission 1. Motion to recommend approval/disapproval for the rezoning request from R-1, Single Family Residential, to R-2, Single Family Residential, for Lot 89, City Block 54, Property ID 13112, located on Appleby Sand Road on staff recommendation and findings. 2.
