Bohac, Don Mills, Ken Deppisch Members Absent: Matt Turner, Stephanie Malott Staff Present: Leo Mantey, Jerri Turner, Caleb Hill Others Present: Roy Boldon 1. Call to Order: Commissioner R.J. Bohac opened the meeting and called it to order at 5:00 p.m. 2. Approval of Minutes: August 13, 2018 Regular Session: Commissioner Bohac called for a motion to approve the minutes. Commissioner Mills made a motion to approve the minutes and Commissioner Deppisch seconded the motion and the motion passed unanimously (3-0) 3. Public Hearing: A public hearing will be held to consider a request and take action for a zone change from A-Agriculture, to I-2, Heavy Industrial, for Lot 28, City Block 59, Property ID 7313, located at 3602 Rayburn Drive. Z18-05. Planning Director, Mr. Leo Mantey introduced the new board member, Ken Deppisch, and stated that he was excited to get to work with him. He then introduced Caleb Hill, the Planning and Zoning intern, and stated that he would be presenting this case as part of his training. Caleb Hill explained this request. He stated that this property is zoned Agriculture. A lot of the property surrounding it is already zoned either Agriculture or Heavy Industrial. This property is also in the 100 year flood plain. The building is not in the flood plain and staff believes it would be best as commercial use rather than residential. Commissioner Mills asked if this property was past the wood plant. City Planner, Leo Mantey stated that yes it is. He stated that the applicant owns both parcels in question. They would rather see an auto mechanic shop there. Bohac asked if there were any further questions. Roy Bolden stated that he wanted to make sure that the owner owned both parcels and that he was aware that this property was in the flood plain. City Planner, Leo Mantey stated that he does own both parcels and he is aware of the flood plain issue. R.J. Bohac asked if there were any further questions and there were none. He called for a motion. Commissioner Mills made a motion to approve the request. Commissioner Deppisch seconded the motion and it was approved unanimously. P&Z Minutes Page 2 Agenda Item #4: Staff briefing on proposed Stakeholders Meeting. City Planner, Leo Mantey, stated that he was concerned about residential development outside of the city. He stated he would like to see more infield development. He would like to hold a discussion meeting to see in what ways the city can partner with developers to encourage in fill development within the city limits. Commissioner Bohac asked if this was just going to be an informal meeting of questions and answers. Mantey stated yes. Commissioner Mills asked if we had an Enterprise zone. Mr. Mantey stated we currently don’t have one. Roy Bolden stated no, we do not have an Enterprise zone. He stated that developers and contractors want growth but they want to dictate where. Leo Mantey stated that there would be a letter going out in reference to the meeting with time and date. Austin State University www.sfasu.edu PLANNING AND ZONING COMMISSION MEMORANDUM AGENDA ITEM # III FROM: Leo Mantey, Director of Planning and Zoning DATE: October 8, 2018 CONDUCT A PUBLIC HEARING AND CONSIDER A REQUEST FOR APPROVAL OF A PLAT FOR THE KENBROOK NORTH ADDITION, SECTION 3, REPLAT OF LOTS 5 & 9, BLOCK 10, LOCATED AT 1822 CHERRYBROOK DRIVE. SUBMITTED BY MICHAEL KINMAN. Background The request is for a preliminary plat approval two lots for the Kenbrook North Addition. The subdivision is located approximately 1,005ft south of NE Stallings Drive along Cherrybrook and Ridgebrook Drive inside the city limits. Plat Design This is a two (2) lot subdivision in a built out residential neighborhood. The site is currently made up of two lots. The purpose of this subdivision plat is to combine the two lots in order to have an accessory building at the rear of the properties. There is currently one home on site, and it will remain as is. All the lots conform to the subdivision regulations stipulated for the R-1 zoning district Proposed Development The site is already developed with a single family home. The owner has not indicated any intentions of replacing or changing the land use. The neighborhood is made of of single family homes with accessory structures. Zoning Issues This property is zoned R-1, Single-Family Residential. This zoning classification requires a minimum lot size of 75ft by 110ft, for a total of 8250 square feet. As shown in the attached plat, the lots exceeds these requirements (39,335sqft), and therefore in conformance with the zoning regulations. Drainage, Utility, and Access Issues Staff has reviewed the plat and determined there are no issues with the plat. All properties proposed will have adequate access. Flood Damage Prevention: No portion of this property lies within the 100 year or 500 year flood hazard areas. Notices: Staff sent out 18 notices to property owners within the 200 foot notification area. There were zero (0) responses received in favor of the request, and zero (0) responses received in opposition of the request. City of Nacogdoches 202 E. The plat does not pose any adverse impact on surrounding properties and is adequately served by all required utilities. 2. The plat conforms to all the zoning and subdivision regulations as stipulated in the City’s Code of Ordinance. Action by Planning and Zoning Commission This subdivision plat must be reviewed by the Planning and Zoning Commission because a public notification is required due to part of the proposed plat lying in an existing subdivision. 1. Motion to approve/disapprove a preliminary plat for the Kenbrook North Addition (Lots 5 & 9, Block 10), generally located at 1822 Cherrybrook Drive, Nacogdoches Texas, based on staff’s recommendation and findings. 2.
