Call to Order: Chairman Matt Turner opened the meeting and called it to order at 5:00 p.m. 2. Approval of Minutes: October 8, 2018 Regular Session: Chairman Turner called for a motion to approve the minutes. Commissioner Mills made a motion to approve the minutes and Commissioner Bohac seconded the motion and the motion passed unanimously (5-0) 3. Public Hearing: A public hearing will be held to consider a request and take action for approval of a zone change from A -Agriculture, to 1-2, Heavy Industrial, for a portion of the property (approximately 701 acres) described as Lots 1-A and 4-A, City Block 65, Property ID 26248, generally located at 2722 Durst Street. Z18-06. Planning Director, Mr. Leo Mantey explained this request. The request is for a zone change from A -Agriculture, to 1-2, Heavy Industrial, on 2722 Durst Street, generally located 507 feet east Loop 224 at the edge of the city limits. The applicant informed staff the land is being rezoned in order to use the property for Stone, Sand, Gravel or Earth Sales and Storage. He stated, the 7.1 -acre property is currently zoned A -Agriculture which allows the property to be presently used for agricultural purposes, newly annexed, for open spaces, or area not yet developed due to unavailability of urban services. The development proposes to change the zoning to 1-2 Heavy Industrial to which allows for industrial uses including the proposed use. If approved, the entire site development will adhere to all regulations and requirements of the 1-2, Heavy Industrial Zoning district. The entire tract of land is approximately 7.9 acres, however 0.8 acres out of the tract holds a residential structure and will remain as is, and will therefore excluded from the rezoning request. It will remain Agriculture. The property to the west is the same use. Mr. Mantey stated that the only issue he had with this request is the increase of the 1-2 district in this are because Durst Street is mostly residential. He stated that staff is concerned with the impact on surrounding properties. He feels this use would not be good for this area. He spoke of the dust, and sound pollution this development could bring to neighboring properties. Chairman Turner asked if there were any concerns about the property to the west and the existing business doing the same type work. Mantey stated no, that this property was not within the city at the time it commenced, but was later annexed to be in the City. Chairman Turner asked if they would be mining sand or crushing stone. P&Z Minutes Page 1 Mr. Mantey stated that the they would be crushing stone and individuals would come onsite to pick it up. Commissioner Deppisch asked if the Future Land Use had been updated since 2003. City Planner, Leo Mantey stated that it has not been updated. Commissioner Deppisch asked if approved what was the plan with the large drop off on property. City Planner, Mantey stated that every lot is developable, but we must be economical in the development, and that is a good point in reference to the terrain. He would however defer that question to the applicant Miles Bradshaw stated that he is the prospective purchaser. He said the use is for the long term, as well as a practical use. He stated the sand would be used for building pads all over the city. He stated that he appreciates the concern of dust but there will be a water truck on site to control that. Chairman Turner stated that the property seemed to drop east. Miles Bradshaw stated that it was 10 feet at the highest. Commissioner Deppisch stated that the dust issue is a good point. Chairman Turner asked if there was any further discussion. There was none. He asked if there was anyone to speak for or against the request. Katie Hensley said she is an adjacent property owner. She stated that some of the cliffs are twenty feet tall and she has watched trees fall through the years. She was concerned about the value of her property if this request was approved. Chairman Turner asked if she had any complaints in reference to the Kolb Excavating business there close by. Katie Hensley stated she had no complaints because she is used to it. She said that the dust issue had not been totally unbearable. She was concerned at how close to the property line they could dig. Mr. Mantey stated that he would have to adhere to the 20 foot setback on each side. Commissioner Deppisch stated that it may require a modification to land, perhaps a retaining wall and he did not know the City's process with that. City Planner, Mantey, stated that he would like to know hours of operation, dust control, and any other measure that will be put in place to ensure that the business that not have any adverse impact on surrounding land uses etc... Katie Hensley stated that she wanted to sell 13 acres for a subdivision, but was afraid if this happened she would not be able to. Miles Bradshaw stated that he thought it would increase the value of her property. Commissioner Bohac stated that he would like to see a topographical map of the property. Gloria Settle stated that she inherited this property from an Aunt and Uncle, so she could not really answer any questions in detail. To her knowledge, they never had any issues of sand, dust, or trees falling. P&Z Minutes Page 2 Katie Hensley stated that she had known Maureen Crawford. She never had a problem because all the trees falling took place on the back of her property, which she was never aware of. Chairman Turner stated he was concerned about the image to adjacent properties. He asked if there were any closing comments. City Planner, Mantey stated they could approve, deny, or table the request. The applicant could come back with more information as required by the Commission. Chairman Turner made a motion to table the request until a site plan with more information was submitted. Commissioner Bohac seconded the motion. The vote was unanimous to table the request. (5-0) 4. A public hearing will be held to consider a request and take action for approval of a zone change from A -Agriculture, to R-4, Multi -Family Residential, for Lot 27, City Block 54, Property ID 24696, generally located on Park Street.Z18-07. City Planner, Leo Mantey stated that this property is vacant and is approximately 36 acres. This rezoning would not have any impact on surrounding properties. This property is not in the flood plain and staff would recommend approval. Commissioner Deppisch asked if they would be required to construct sidewalks. Mantey stated no, not at this time. He stated that before the property was ever developed, they would have to come forward with a plan and plat of some kind, which would show access, utilities, drainage and meet the city regulations. Tammy Jones stated that she is the daughter of the applicant and that the applicant also owns lot 20, which is 8 acres and will serve as access from Park Street. Chairman Turner asked if there was any further discussion. There was none. He called for anyone to speak for or against. There was no one. He called for a motion. Chairman Turner made a motion to approve the request. Commissioner Deppisch seconded the motion and the request was approved unanimously. (5-0) 5. Staff Updates i. Scenic City Certification Award: City Planner, Mantey, explained this award. He stated that, our city does have room for improvements. The award is judged on signs, landscaping, sidewalks, and other sections in the entire ordinance. We will do more moving forward. Next time we will go for the Gold or Platinum. ii. Stakeholders Meeting: City Planner stated that the meeting was held on Thursday night, November 8m Approximately 30 people attended, and the issue for discussion was how the city could partner with stakeholders to encourage building inside the city as opposed to the county. Most of the comments were reflected towards the school district. NISD Superintendent, Alton Frailey spoke on behalf of NISD. Basically, most discussion was the difference in cost when building in the city and county. Most of the attendees claimed it was cheaper to build in the county. 6. Currently, the middle lot, as referenced on the location map, does not meet the minimum subdivision requirements for lot area. Planning and Zoning Commission NacoRdoches Date: December 17, 2018 the oldest town in Texas Agenda Item: 5 PRESENTER: Leo Mantey, Planning Director ITEM/SUBJECT: Public Hearing: Consider ordinance approving a specific use permit within the City of Nacogdoches for Lot 12 Block 50 Pearl Street. Submitted by Cody Cogdill. SUP18-01. Background The request is for a specific use permit to allow a communications tower inside A -Agriculture zoning on Lot 12 Block 50 Pearl Street, located on the corner of Pearl Street and Bowie Street. The 9.05 -acre property is currently zoned A -Agriculture which allows the property to be presently used for agricultural purposes, newly annexed, for open spaces, or area not yet developed due to unavailability of urban services. City zoning requirements allows communication towers via Specific Use Permit (SUP) on lots zoned for A -Agriculture, a communications tower. The applicant has had several interactions with city staff and has submitted this final application and plans based on city ordinances and staff recommendations. Existing Land Use The lot is undeveloped and abounds vacant (undeveloped) and residential zones. Zoning The zoning designation for the said property is A -Agriculture. Future Land Use Per the 2003 Nacogdoches Comprehensive Plan, the Future Land Use designates about 30% of the property as Rural Development. The remaining portion is designated as Vacant to allow for any use that fits the demand of the neighborhood. Factors to be Considered in Approving an SUP Per Section 118.173 of the Nacogdoches Code of Ordinances, the following factors are to be considered when considering an SUP: Compatibility The area is close to West Austin Street, near the undeveloped flood plain. From this, much of the land to the north and west has been left vacant and overgrown. To the south are residential uses, University Court Apartments, and to the east are more multi -family, two-family, and single-family residential uses. While there are present low -intensity residential uses surrounding this property, the proposed use is for a well engineered monopole which will not have any adverse impact or increase the development in the area. The development will also not change the zoning of the area. The development will add some benefit to the neighborhood and city by giving a better communication coverage or reception. Orderly growth and development The establishment of the specific use will not impede the normal and orderly development and improvement of surrounding properties. The development will not increase the density in development or population within the area. The applicant was given a list of criteria/subdivision regulations to follow to ensure orderly development which has been adhered to. The applicant also submitted a site plan that NacoRdocheso-_ the oldest town in Texas Planning and Zoning Commission Date: December 17, 2018 Agenda Item: 5 will be implemented with no changes during the construction stages. The monopole tower is well engineered and will be placed on sight with extreme precaution and will have frequent maintenance to ensure that it does not have any adverse impact to surrounding uses. Supporting Facilities The site is adequately served with all basic utilities. Per the general notes provided in the site plan, care shall be taken to locate all existing underground obstructions, utilities, and easements before digging or drilling on this site. Drives and Parking A driveway has been provided on site, which is wide enough to park vehicles for construction or routine maintenance. This driveway will conform to subdivision standards. Nuisances During the construction stages, staff believes there might be some sort of nuisances occurring in the neighborhood. However the monopole tower will not create any other nuisances to surrounding properties once constructed. It is self -functioning and will only be visited randomly by personnel for maintenance. Lighting The monopole tower will not be lighted but lighting will be provided for personnel use during maintenance. Planning and Zoning Commission NacoRdoches Date: December 17, 2018 the oldest town in Texas Agenda Item: 6 PRESENTER: Leo Mantey, Planning Director ITEM/SUBJECT: Public Hearing: Consider ordinance approving a specific use permit within the City of Nacogdoches for 2722 Durst Street. Submitted by Miles Bradshaw. SUP18-02. Background The request is for a specific use permit to allow a Stone, Sand, Gravel and Mineral Extraction, on 2722 Durst Street, generally located 507 feet east Loop 224 at the edge of the city limits. The 7.1 -acre property is currently zoned A -Agriculture which allows the property to be presently used for agricultural purposes, newly annexed, for open spaces, or area not yet developed due to unavailability of urban services. A Specific Use Permit is required to allow, a Stone, Sand, Gravel and Mineral Extraction use in an Agricultural Zoning. If approved, the entire site development will adhere to all regulations and requirements of the A -Agriculture Zoning district. Existing Land Use The lot has a residential building on site and abounds industrial and residential zones. Zoning The zoning designation for the said property is A -Agriculture. Future Land Use Per the 2003 Nacogdoches Comprehensive Plan, the Future Land Use designates about 15% of the property as Commercial. The remaining portion is designated as Vacant to allow for any use that fits the demand of the neighborhood. Factors to be Considered in Approving an SUP Per Section 118.173 of the Nacogdoches Code of Ordinances, the following factors are to be considered when considering an SUP: Compatibility The area is in close proximity to Loop 224, and has mixed uses of residential, commercial and a large tract of land for industrial use which is being used for Stone, Sand, Gravel or Earth Sales and Storage. The stretch of land along Durst Street is primarily residential with pockets of vacant land that have been zoned for residential uses. The applicant has proposed this specific use permit for the intended use because of the similar use existing next door. The same business adjacent to this property has been in existence for over 20 years. Staff believes that having the same type of use next door will have adverse impacts on surrounding land uses. The area is primarily made of varying residential uses, and therefore increasing the presence of a stone and sand quarrying and movement along this residential neighborhood will not be ideal for the residences along the street. Orderly growth and development The development will adhere to all subdivision regulations. Based on the site plan provided, it is likely the proposed use will level the land for future development. An orderly development of the same use might increase the adverse effect of this use within the neighborhood. Supporting Facilities The site is adequately served with all basic utilities. All developments such as driveway, parking, etc. will have to conform to current development standards. Drives and Parking A driveway and parking spot for the business use will be provided. They will have to conform to current city development standards. Nuisances Staff believes that before approving this development, dust, fumes, and noise pollution should be considered as issues of concern. Lighting The development does not propose any lighting. Landscaping The development does not propose any landscaping on site. Conformity to the 2003 Comprehensive Plan Over the years, development along Durst Street and inside the Loop has been primarily residential. It will therefore be appropriate to designate or propose residential uses or other non-residential uses that will be compatible with residences. In the desire to harmonize land uses in an area, it is always relevant to consider the predominant use or zoning and then allocate future use or zoning that will blend and integrate better. Approving this specific use will not be a great fit for the surrounding zone and use, and will defeat the vision of the Comprehensive Plan which states; Nacogdoches, the "Oldest Town in Texas," appreciates and protects its historical, natural, and cultural character, promotes a healthy living environment, and enjoys future growth and prosperity. Staff does not believe the proposed use conforms to the 2003 Comprehensive Plan in that area. Notices: Staff sent out 8 notices to property owners within the 200 foot notification area. There were zero (0) responses received in favor of the request, and zero (0) responses received in opposition of the request. Staff Findings and Recommendation Staff will like to outline the following findings: • It is important to note that there is an existing use of the same nature to the west of the property. This SUP if approved will likely increase the adverse impact on residential uses along this street. Some other enclosed industrial or commercial land use with less impact NacoRdocheso-_ the oldest town in Texas Planning and Zoning Commission Date: December 17, 2018 Agenda Item: 6 will be a better fit for the area since it won't increase the negative impact on residential street. • Staff believes a Stone, Sand, Gravel and Mineral Extraction use will have a detrimental effect on the neighborhood; there is already a similar one in -use adjacent to the property on a street that is wholly residential. Staff believes the proposed industrial use in a residential neighborhood will increase existing negative environmental impacts, such as increased air, fume and sound pollution and will reduce the surrounding neighborhood quality. • Residents living in proximity to quarries can potentially he affected by dust up to 0.3 miles from the source, although continual or severe concerns about dust are most likely to be experienced within about 328ft of the dust source. The main potential impacts of dust are visual impacts, coating/soiling of property (including housing, washing, and cars), coating of vegetation, contamination of soils, water pollution, change in plant species composition, loss of sensitive plant species, increased inputs of mineral nutrients and altered pH balances. Respirable particles, i.e. those less than 10 micrometers in diameter, have the potential to cause effects on human health, depending on exposure levels. (Quarries and Ancillary Activities, Guidelines for Planning Authorities) • The applicant has submitted some documents to give more information on the project (see attached documents) Based on the above findings, Staff would recommend the Planning and Zoning Commission consider the above findings before making a recommendation on the SUP. Background This is an application for a Specific Use Permit (SUP) for the permitted use of Stone, Sand, Gravel and Mineral Extraction on a property located at 2722 Durst Street and currently zoned Agricultural (A). In the alternative, this request is also presented as an application to re -zone the 7 -acre portion of 2722 Durst from Agricultural (A) to Heavy Industrial (1-2) (as shown in Exhibit 1 — Subject Property Plat). This request was initially considered as a potential re -zoning by the P&Z Commission at a public meeting on November 12, 2018. The matter was tabled. After more detailed information was provided to the City Planner, it was determined that, according to the City's Land Use Schedule, this request could be considered as either an SUP application or a re -zoning. (Exhibit 2 - Land Use Schedule). The preferred action depends on the City's proposed conditions, if any, that might be required as part of an SUP. Below is a description of the neighboring properties, the proposed activity, including a site plan, topography map, and a description of protections of neighboring property. B. The Area Subject Property (2722 Durst) - The Applicant is a prospective purchaser of the property at 2722 Durst Street, a 7.906 acre tract of land ("Subject Property") currently zoned A (Agricultural). It has a small well-maintained older home at the front of the Property near Durst Street. (Exhibit 1 — Subject Property Plat). Kolb Property (to the West) - The contiguous property on the western border is the property commonly known as the David Kolb Dirt Excavation site ("Kolb Property") where dirt materials have been excavated for many years and is now almost entirely excavated to about 5-10 feet above street level. The Kolb Property is zoned 1-2 (Heavy Industrial) according to the City Zoning Map (Exhibit 3 — City Zoning Map). Between the Kolb Property and the West Loop feeder road there are two narrow tracts zoned General Business. Hensley Properties (to the East) - To the east of the Subject Property is a contiguous 8.47 acre tract currently zoned Agricultural. It is of similar size and shape as the Subject Property, and is owned by an individual, Ms. Katie Hensley. Ms. Hensley also owns the 4.18 acre tract contiguous with her 8.47 acre tract. However, according to the City Zoning Map (Exhibit 3) the 4.18 tract is currently 1 zoned Heavy Industrial (1-2). Each tract appears to have a residence near Durst street (collectively the "Hensley Properties"). C. The Proposed Use/Project The proposed use of the back 7 acres of the Subject Property is the excavation of red and white sand materials, and eventual leveling and sloping of the land to a level compatible with the neighboring lands and the Subject Property's 1 -acre home site. With the adjacent Kolb Property already excavated down to a more easily developed property for future commercial or similar uses, it makes sense for the back 7 acres of the Subject Property to also be excavated to a compatible level. The applicant is contracting exclusively with Duck's Dozer (Toadie Duckett, owner) to complete the excavation project. It is expected the excavation will take 5 to 10 years depending on demand for the material. The sand material is used primarily to build up home and commercial building site pads. Demand for the material is driven in large part by building activity in Nacogdoches and surrounding areas. The existing residence on the Subject Property will continue to be used as a residence. If the City's action is re -zoning, the applicant will survey out and sub- divide about an acre tract around the residence as shown in Exhibit 1. If an SUP is granted, no subdivision is necessary. 1. Topo Map (Exhibit 4) The topo map indicates the Subject Property slopes eastward toward downtown and the drop in elevation from the west boundary to the east boundary (the Hensley property line) through the majority of the excavation area is about 10 feet - from an elevation of 442 feet to 432 feet. The Subject Property also slopes somewhat from north to south from a high of 445 feet in the back northwest corner of the Property to a low on the front southern boundary at Durst Street of about 405 feet. The elevation on most of the Kolb Property in the flat areas is about 410- 415 feet. (Exhibit 4) 2. Site Plan (Exhibit 1) a. Excavation - The applicant has the Subject Property under contract, and upon closing the sale will contract exclusively with Duck's Dozer (owned by Mr. Toadie Duckett) to gradually excavate the dirt materials from the Property down to an elevation of about 412-415 feet (slightly higher than Kolb Property). The excavation is expected to occur gradually over a 5 to 10 year period, and would occur during regular business hours (8 a.m. — 5 p.m.). 2 b. Crushed Concrete Driveway/Fence and Locked Gate — As shown in Exhibit 1, we intend to make a crushed concrete driveway from Durst Street extending north about 150 feet to a locked double gate fenced entrance just behind and to the west of the house. The fence and gate will run east to west behind the house across the Subject Property. We have confirmed with City engineers that the driveway can be installed such that the entrance on Durst Street will have a distance of over 120 feet on each side between it and the existing driveways - one on the Kolb Property to the west, and one on the Subject Property extending to the residence. c. Gradual Clearcutting — The Property has some brush and small/medium timber (mostly hardwood) that will be cleared as needed by Duck's Dozer to excavate material starting at the back (north) end of the Subject Property and moving toward the front (to near the fence behind the house). An area for burning brush piles will be made near the back/middle of the Subject Property so as to meet the City Fire Marshal's distance requirements of a minimum 300 feet from a structure and a minimum 50 feet from any boundary line. d. Equipment On -Site - Duck's Dozer will exclusively perform the work needed to complete the project — crushed concrete driveway, fence and gate, clearcutting, outdoor burning and excavation. The heavy equipment on site will vary from time to time (since it may be used on other job sites), but generally is expected to include: 1-2 medium-sized dozers; 1-2 large backhoes; 1-2 dump trucks; and a medium-sized water tanker truck. Duck's Dozer owns a water tanker truck that will be used to minimize dust from the excavation activity and to enhance the safety of any permitted outdoor burning. The operators' personal vehicles will be parked on-site during regular business hours (8 a.m. — 5 p.m.). e. Protection of Neighboring Land — The Property has three neighboring properties: (1) LUDCO Electric to the north; (2) the Kolb Property to the west; and (3) The Hensley Property to the east (a rent home on 8.47 acres (2600 Durst); Ms. Hensley also owns the next property eastward - a 4.18 acre tract (2620 Durst). To date, Ms. Hensley is the only person/entity to respond to City notices of possible re -zoning. She appeared and spoke at the November 12, 2018 P&Z meeting. Ms. Hensley's primary concern was that her boundary not suffer erosion resulting from the excavation. 3 For the two reasons described below, erosion should not be an issue. 1. 2.0 -Foot Setback — If an SUP is issued, the applicant is amenable to a condition in the SUP of a 20 --foot setback from the shared boundary. That amount of undisturbed earth should more than suffice not to create any erosion issues on Ms. Hensley's boundary. As an example, one can view the existing cut line on the Kolb Property, existing for several years, and see that no significant erosion has occurred. The subsurface material has very good holding strength — one reason it is used for building site pads. 2. Slope Extends Eastward Awav from Common Boundary — As shown in the topography map (Exhibit 4), the slope of the land extends eastward away from the common boundary between the Hensley Property and the Subject Property. As such, there will be no water drainage over the cut line that might arguably contribute to erosion. All drainage from the cut line toward and continuing across Ms. Hensley's property will slope downward. Based on the strength of the subsurface material, the cut line should not erode at all, and certainly not if the cut line exists 20 or more feet from the boundary line. D. Ordinance Factors for Re -Zoning or SUP City Ordinance Section 118.173 gives eight (8) relevant factors for consideration by the P&Z Commission/City Council when considering a request for re -zoning and/or a specific use permit. The applicant asserts that the proposed project and use meets those factors, whether ultimately determined to be a re- zoning from Agricultural to Heavy Industrial or an SUP. Compatibility. With a sand excavation site immediately next door already zoned 1-2 that has operated with no complaints for many years, designating the subject property as 1-2 for the same purpose is compatible with the area. While the Hensley Property has a small residence near the front of its 8 -acre tract, considering the similar size and because the Subject Property home site will remain as a separate property, there will be little, if any disruption of the current use of that property. Behind the Subject Property is the LUDCO Electric business site, whose commercial use is compatible with the Subject Property as well. Finally, according to the City's Zoning Map, the 4.18 acre tract owned by Ms. Hensley is already zoned Heavy Industrial (1-2). Orderly growth and development. The proposed use maximizes the current development of the Subject Property consistent with the area. The expected development and widening of Highway 69 along the West Loop will likely result in 2 additional commercial/business development of the highway properties near the intersection of Durst and Highway 69. Excavating the back 7 -acres at or near the level of the Kolb Property will only benefit and encourage future commercial uses and opportunities for all nearby property. In turn, this should result in an increase in future tax base for the City. Supporting Facilities. The crushed concrete driveway to be added to the Subject Property will be constructed at a location that allows just over 12.0 feet on either side to the next driveway access on Durst Street. If the City's action is an SUP, the applicant is amenable to a condition that the crushed concrete driveway is a temporary driveway used only during the excavation period, and it would be removed upon completion of the excavation project. Drives and Parking. As noted above, the only on-site parking required is the equipment described above and parking for the operator's personal vehicles during work hours (both of which will always remain behind the locked gates). Nuisances. With the existing similar use taking place over the last several years on the Kolb Property, issues such as dust, fumes and noise should not be an issue. The water tanker truck will be used to minimize dust and enhance the safety of periodic permitted brush pile outdoor burning. Lighting. Not applicable. Landscaping. Not applicable. Comprehensive Plan. The City's comprehensive plan encourages compatible development for the City. This project enhances future development in the area. Thank you for your consideration.
