Bohac, Stephanie Malott, Ken Deppisch, Don Mills, and Nancy Day Members Absent: Don Mills Staff Present: Jerri Turner, Keith Kiplinger Others Present: Robert Ault, Caleb Hill, Kyle Lee, Jay Modi, Keith Socia, Vicki Socia. 1. Call to Order:Commissioner Bohac called the meeting to order at 5:00 pm. 2. Approval of minutes: July 8, 2019 Regular Session Commissioner Deppisch made a motion to approve the minutes, with the correction of a date. Commissioner Malott seconded the motion and the request was passed unanimously. 3. Public Hearing: Consider the request for approval of a Specific Use Permit (SUP) for an RV Park within the City of Nacogdoches for 4925/5001 NW Stallings Drive, Lot 18, City Block 95, Parcel ID 26729. Interim Planning Director, Keith Kiplinger, stated that he has been named Interim while searching for another Planning Director. He stated that this property is currently a recreation/vehicle park that would reclassify as an RV Park. There are over 11 acres and would accompany up to 119 spots. This would be a higher quality and caliber. The applicants intend to exceed the landscaping requirements. There are conditions with this SUP. The length of stay for one resident would be no longer than 180 days. Commissioner Malott asked if this was already tied into or is there a dump station on site. Keith Kiplinger stated that the future site would have an on site dump station. Chairman Bohac asked about the driveways. Keith Kiplinger stated that would be up to Engineering. There would be some paved roads with either asphalt or concrete. Chairman Bohac asked who would police the coming and going of the residents. Keith Kiplinger stated it would be by complaints or the owners could also be required to maintain a log. Commissioner Deppisch asked about the SUP’s granted recently and how the conditions were being memorialized. Kiplinger stated that there are city ordinances on file so it is inforcible. There is one to go before City Council as we speak. Commissioner Malott asked who would police this area. Kiplinger stated that the current property in question has flown under the radar, but now that it is back on the radar, there is a way to close the loop. He stated that there can be conditions added to make the board feel comfortable. Chairman Bohac asked if there were any questions. There were none. He asked if there was anyone to speak for or against the request. P&Z Minutes Page 2 Keith Socia stated that this is not their first RV Park to build. He has built five or six. We want to make the property pretty. It will take approximately a year to complete but it will be nice. Vicki Socia stated that she and her husband are love to take their RV places. She is from Nacogdoches and wants to bring advertisement to show everything there is to do in Nacogdoches and what Nacogdoches has to offer. She stated that there will be up to 119 spots phased in. They would first build a nice office, shower facilities. Commissioner Day asked what the going nightly rate was. Vicki Socia stated that some asked $30.00 a night, but probably a minimum of $40.00 a night. Commissioner Malott asked if they could add the condition of the owners maintaining a log of customers and their stay. Kiplinger stated of course. Chairman Bohac called for a motion. Commissioner Deppisch stated that he make a motion to approve request with conditions stated and add condition that property owners keep a log of vehicle /RV use of the property to determine time limit. Commissioner Malott seconded the motion and it passed unanimously. 3. Public Hearing: Please consider the request for approval of a Specific Use Permit for a light manufacturing company in a B-2, General Business zoning district, on Lot 95-E-2, City Block 56, Parcel ID 25533, generally located at 3804 South Street. Interim Planning Director, Keith Kiplinger, stated that this request will allow expansion of Mast Motorsports. This building was Elliott Electric and they found an occupant who needed to expand. There will only be a few structural changes. They will add to the front portion. The SUP will have no reverse impacts and has a couple of restrictions with it. Chairman Bohac stated that the building and parking lot to the North. He asked if there was anyone to speak for or against the request. Robert Ault stated he has no concerns. The building has always been kept up and maintained. Kiplinger stated that it would be occupied within 12 months. He stated that it is considered a lighter manufacturing because there is no smoke produced, no noise, no odor, no lighting. This makes it a lighter use than a machine shop. Chairman Bohac asked if there were any more questions or discussions. There were none. He called for a motion. Commissioner Deppisch stated he would make a motion to approve the request with conditions. Commissioner Malott stated she would second the motion. It was approved unanimously. The subdivision has been platted and constructed in phases and the proposed plat would add 18 single family residential lots to the development. STAFF REVIEW: The City Engineer and Interim City Planner have reviewed the proposal and found that the design conforms to City standards. Lot sizes range from .288 to over 1.3 acres. This subdivision will be constructed on a private road and no City or County maintenance will be required. The City Engineer has re determined there are adequate utilities in the area. There are currently no drainage issues. STAFF RECOMMENDATION: Staff recommends approval. The bulk of the lot was rezoned B-2 General Business in May 2019. A small area zoned R-1 Single Family that was previouslyaseparatelotwasinadvertentlyleftoutoftherezonebystaff. Theproposed rezoningisatthesiteofthe ClineMedical OfficeBuilding and thesmall R-1 section was discovered during the permit process. The entiresiteis West of Calvary Baptist Church property which is zoned R-1. Churches are permitted by right in the R-1 zoning district but a medical office building is not. The portion of the lot that is proposed for rezoning will include a drivewayandsmallportionoftheparkinglot. ExistingLandUseandZoning The subject property is currently zoned R-1 Single Family and there is no current use of the subject property. The surroundinglandusesareasfollows: There is high traffic along this corridor and staff does not any adverse impacts from commercial use of the subject property. Flood Damage Prevention: Per the FEMA Floodplain Map, there is no portion of the property that falls in the 100 or 500 foot floodplain area. Notices: Staff sent out 13 notices to property owners within the 200 foot notification area. There were zero reaponses.
