P&Z Agenda Packet 12-14-2020 Naco doches the oldest town in Texas Notice is hereby given of a Regular Meeting of the Planning and Zoning Commission to be held on December 14, 2020 at 5:00 p.m., via teleconference or videoconference, with the opportunity to appear in person in the Council Chambers, Room 119 of City Hall, 202 E. Pillar Street, Nacogdoches, Texas, for the purpose of considering the following agenda items. All agenda items are subject to action. In accordance with Orders of the Governor due to the COVID-19 pandemic, the City of Nacogdoches Planning & Zoning meeting will be deemed as being conducted via teleconference or videoconference. However, some Board Members may attend virtually, while others may be present in the above stated physical location. Regardless, the meeting will be streamed live at www.ci.nacogdoches.tx.us/21. There will be an opportunity for the public to comment on agenda items either by teleconference or in person in Council Chambers. For those attending in person, strict adherence to COVID-19 related CDC guidelines will be enforced at all times. Members of the public who wish to submit comments on a listed agenda item in writing or via teleconference must contact the Planning & Zoning office by email at pollettej(a)nactx.us or by calling 936-559-2574 and providing their name, telephone number and relevant agenda item upon which they wish to speak. Bohac, Stephanie Malott, Ken Deppisch and Don Mills Members Absent: Staff Present: City Planner, Alaina Chafin; City Engineer, Steve Bartlett; Planning Technician, Juan Pollette; and IT Technician, Justin Bailey Others Present: Varrnon McLemore, Ron Collins 1. Call to Order: Chairman Bohac called the meeting to order at 5:04 pm. 2. Approval of minutes: August 10, 2020 Regular Session Commissioner Malott made a motion to approve the minutes, and Commissioner Deppisch seconded the motion and the minutes were approved unanimously. 3. Consider a Zone Change from R-4 Multi Family, to M Medical, for property being a portion of Lots 2 and 3, Block 2, of the Blount Estate Subdivision recorded in Volume 1404, Page 138 of the Deed of Records of Nacogdoches County, Texas, Property ID 27684, located at 614 East Starr Avenue. This request has been submitted by Christ Episcopal Church. City Planner Chafin presented the Rezoning to the Commission, recommending approval. Commisiner Malott asked how long ago were 200' letters sent out to residents. City Planner Chafin stated that notices were sent out on September 3, 2020 and that the legal requirement is 10 days prior to the meeting but are usually sent out 15 days prior to meeting to give a buffer. Chairman Bohac asked if anyone else on the Commission had any questions of Staff, and there were none. Chairman Bohac opened the public hearing. City Planner Chafin stated that no one had signed up to speak on this item. Chairman Bohac asked if there were any questions for Collins. Chairman Deppisch asked Collins how many parking spots he will need for the facility and if he had a tenant lined up. Collins stated that he does not have a tenant yet and that he plans on putting 10 parking spaces in the back of the building. Collins spoke with Dr. Sowell and they agreed to use a portion of Dr. Sowell's adjacent property for additional parking. Collins stated that there is a mature tree that was to be removed in the original plan but will now try and keep. Collins also stated that Dr. Sowell will grant Collins access to easement access for the driveway into the property off of Starr Ave. Commissioner Malott asked Collins if he perceives the building to have only one tenant or multiple. Collins responded saying that it will only have one tenant. P&Z Minutes Page 1 Chairman Bohac called for a motion for or against item number three. Deppisch made a motion to approve the request. Commissioner Malott seconded the motion and the request was approved unanimously. (5-0) 4. Consider a Zone Change from PD Planned Development to PD Planned Development to amend the terms of the PD and the associated Development Plan for Lots 1 and 10, Block 1; Lots 1 and 10, Block 2; and Lots 1 and 18, Block 3 of the Austin Hills Subdivision. This request has been submitted by Varron McLemore. Chairman Bohac and Commissioner Malott recused themselves from this item because of a conflict of interest. Commissioner Deppisch stepped in as Chair for this item. City Planner Chafin presented the Rezoning to the Commission, recommending approval. City Planner Chafin stated that Staff had been contacted by one of the neighborhood residents with general questions regarding the request, but had received no contact in support or in opposition of the request. Commissioner Deppisch opened the public hearing. City Planner Chafin stated that no one had signed up to speak on this item. Commissioner Deppisch closed the public hearing. Commissioner Deppisch asked if anyone else on the Commission had any questions of Staff, and there were none. Commissioner Deppisch had a question for Mr. McLemore and asked if the goal of this zone change was to help build houses that are similar to the ones in surrounding lots. Mr. McLemore stated that was the main reason. Commissioner Deppisch asked if there were any further comments or questions, and there were none. Commissioner Deppisch called for a motion. Commissioner Mills made a motion to approve the request. Commissioner Day seconded the motion and the request was approved unanimously. (3-0) 5. City Planner Chafin explained the discussion and possible action on future agenda items to the commissioners. Commissioner Malott asked about water lines on King St. Chafin explained that they are putting in new gas lines in that area. Commissioner Deppisch asked about the development around the new 1-69 corridor. City Planner Chafin stated that Staff issued a request for proposals late last year for a consultant to do a long range corridor plan for future utilities and land use. Austin Street. This request has been submitted by Curtis Architecture-Army Curtis. Case File PD2020-03. SUMMARY/BACKGROUND: Background The Austin Hills Subdivision is zoned PD, Planned Development for a single family neighborhood, with the vacant church on Opal Drive currently planned for a future senior center. The original PD approval called for a church on Lot 1 and a future nursing home or assisted living center on Lot 2. Lot 1 was developed and a currently vacant church is located on the property. Lot 2 was never developed. The PD Concept Plan was amended in January 2020 to allow for the conversion of the church into a senior citizen center and the land in Lots 1 and 2 to be used for purposes consistent with serving meals and providing services to senior citizens. The proposal provides for a 50-foot building setback on the eastern property line shared with residential lots.This Development Plan approval is the last step before the final Site Plan may be considered by the Planning and Zoning Commission. Existing Land Use and Zoning The subject property is currently zoned PD, Planned Development. Lot 1 is currently a vacant church building and Lot 2 is currently undeveloped. The surrounding zoning and land uses are as follows: Direction Comprehensive Plan Zoning Land Use North Single Family PD, Planned Residential (Across W. Residential Development Austin St.) South Rural Development A,Agriculture Vacant East Single Family PD, Planned Residential Residential Development West Single Family A,Agriculture Vacant Residential Future Land Use Per the 2003 Nacogdoches Comprehensive Plan,the Future Land Use designates the property as Single Family Residential which is defined as: `Single-Family Residential: Conventional one family detached dwellings(also includes duplexes)" The comprehensive plan also details that: `Schools, parks and community facilities should be located close to or within residential neighborhoods"and 'Residential developments should include adequate area for parks and recreation facilities,schools and churches." Planning & Zoning Commission Naco!zdoche Date: December 14, 2020 the oldest tarn in Texas Agenda Item: 3 REVIEW CRITERIA Per Section 118.392 of the Nacogdoches Code of Ordinances, Based upon the concept plan or development plan,the following conditions shall be considered when reviewing a development plan: a. The plan of development is generally consistent with the future land use policies and map in the adopted comprehensive plan. b. Proposed uses and the configuration of uses are compatible with existing and planned adjoining uses. c. The general arrangement of streets conforms to the adopted thoroughfare plan. d. Proposed uses and development densities and intensities are consistent with the purposes and standards of the planned development district regulations. e. The proposed plan for development furthers the public health, safety and general welfare of the community. Staff Findings &Recommendation The request meets the review criteria outlined above, and the proposed Development Plan is consistent with the Concept Plan approved by City Council earlier this year. Based on the above findings, Staff recommends approval of the request. Notices Staff sent 15 notices to property owners within the 200 foot notification area. Since the time of this report Staff has received no contacts regarding the request.
