Notice is hereby given of a Special Meeting of the Planning and Zoning Commission to be held on Friday, July
9, 2021 at 9:00 a.m., with the opportunity to appear in person in the Council Chambers, Room 119 of City
Hall, 202 E. Pilar Street, Nacogdoches, Texas, for the purpose of considering the following agenda items.
All agenda items may be subject to action. There will be an opportunity for the public to comment on agenda
items in person. Members of the public who wish to submit comments on a listed agenda item in writing must
contact the Planning & Zoning office by email at pollettej@nactx.us or by calling 936-559-2574 and providing
their name, telephone number and relevant agenda item upon which they wish to submit a comment. All
requests to make comments in writing must be received by 5:00 p.m. on Thursday, July 8, 2021.
PLEASE LIMIT PRESENTATIONS TO THREE MINUTES (UNLESS PRIOR APPROVAL IS OBTAINED)

3. Administer Statement of Officer and Oath of Office for newly appointed Planning & Zoning Commission

4. RECOGNITIONS:
a. Public service recognition to honor Commissioners'service to the citizens of Nacogdoches.
5. Open Forum: In addition to public comment on agenda items, the Commission offers an open forum
whereby citizens may comment on governance issues over which the City of Nacogdoches has domain.
In accordance with the Texas Open Meetings Act, members of the Commission shall not discuss,
deliberate, or make any decisions on topics not posted as an agenda item. Speakers should address all
remarks to the Commission and limit your remarks to no more than 3 minutes.
6. REGULAR AGENDA:
a. Welcome and introductions.
b. Presentation, discussion, and possible action regarding the Planning &Zoning Commission's
roles and responsibilities, terms of appointment, tentative meeting dates, meeting procedures,

The Commission may conduct Executive Session deliberation, reconvening open session for
action, if any, on Executive Session items. Regular Session agenda items appropriate for Executive
Session consideration may be moved into Executive Session for deliberation, but not action, upon
proper announcement at the meeting by presiding officer. If litigation or attorney-client privileged
information issues arise as to the posted subject matter of this Planning and Zoning Commission
meeting, an executive session may be held.
7. EXECUTIVE SESSION:
a. Consultation with City Attorney — Pursuant to Texas Government Code Section 551.071, the
Planning and Zoning Commission may seek advice from its attorney regarding a pending and
contemplated litigation subject or attorney-client privileged information. If litigation or attorney-
client privileged information issues arise as to the posted subject matter of this Planning and
Zoning Commission meeting, an executive session may be held.

ITEM/SUBJECT: Presentation and discussion of the topic of the Texas Open Meetings Act
and how it relates to the Planning&Zoning Commission.
SUMMARY/BACKGROUND: For purposes of the Texas Open Meetings Act (TOMA) the
Planning and Zoning Commission is a "governmental body". One of the main purposes of
TOMA is to have the public business of a governmental body conducted at a meeting open
to the public so any deliberation will occur before the public. The purpose of this
presentation and discussion is to provide an understanding of the law to assist the
Commission when they face potential legal conflict according the statute.
